摘要
目的: 归纳分析我国医用耗材集中采购过程中相关主体存在的违法违规行为,为完善医用耗材集中采购行为监管提供一定参考。方法: 搜集医用耗材集中采购相关学术文献、政策文件、官方报道、法律法规及裁判文书等资料并汇总分析,梳理存在问题。结果: 医用耗材集中采购过程中药械企业、医疗机构、招采机构可能存在多种违法违规违约行为,相关法律法规暂未出台,现行处理依据主要为医药价格和招采信用评价制度与各地政策。结论: 目前医用耗材集中采购存在法律法规尚不完善、违法违规行为监管困难等现实问题,建议尽快出台医疗保障法、完善监督管理机制、加强部门协同配合,以推动医用耗材集中采购工作高质量发展。
Abstract
Objective: The paper attempts to provide a reference for improving the supervision of centralized procurement of medical consumables by summarizing and analyzing illegal behaviors of relevant parties in the centralized procurement process of medical consumables in China. Methods: Relevant academic literature, government documents, official reports, laws and regulations, judgment documents and other materials were searched through open channels and problems were analyzed. Results: In the centralized procurement of medical consumables in China, there may be different types of illegal behaviors involving enterprises, medical institutions, and centralized procurement agencies. There is no medical consumables procurement laws and regulations at present. Violations are mainly regulated and punished according to the drug price and credit evaluation system and local policies. Conclusion: At present, there are difficulties in the centralized procurement of medical consumables, such as imperfect laws and regulations and difficulties in supervision of illegal behaviors. It is suggested to enact the healthcare security law, improve the supervision and management mechanism, and strengthen the collaboration of multi-departments to promote the high-quality development of the centralized procurement of medical consumables.
